Representation of Health Care Professionals

Osteopathic physician – Favorable negotiation of a restrictive covenant (non-compete agreement) on behalf of a local physician who had left her at-will employment with a physician group. Dr. Quinn was able to successfully demonstrate that the terms of the agreement were overly expansive and against public policy as initially written. He was able to curtail the terms of the restrictive covenant to include unrestricted admission and unlimited treatment privileges at hospitals located within the restricted area on behalf of the physician.

Chiropractor – Successful litigation defense and ultimate dismissal obtained of charges of violations for the New Jersey Civil RICO Act (Racketeer Influenced and Corrupt Organizations Act), Consumer Fraud, Common Law Fraud, and Contract claims on behalf of a California Chiropractor and his medical device corporation.

Dentist – Successful dismissal obtained on behalf of a local dentist being sued in a contract dispute by a large medical device corporation.

Nurse – Successful defense and acquittal obtained through trial of a N.J.S.A. 6:B (2) charge carrying a mandatory minimum 1-year loss of driving license. On behalf of the nurse, Dr. Quinn tried the case and was successful in defeating the charge and saving this nurses’ driving privileges and preserve her ability to commute to her hospital.

Podiatrist – Current representation of a podiatrist in a pending consumer fraud action against a medical device company. The claim seeks reimbursement for medical screening equipment purchased under alleged false pretenses and misrepresentations. Litigation is ongoing and pending.
